Terms of Service

This agreement defines the basic rules for using averisca.cloud services.

1. Liability

1.1. The user is responsible for installed software, content, settings, and actions of users on their server.

1.2. The service operator is responsible for hosting infrastructure operation within the selected plan and these terms.

1.3. The service does not guarantee compatibility or stability of third-party mods, plugins, server cores, and other software.

2. Service Rights

2.1. Support is provided through the ticket system and by email at support@averisca.cloud.

2.2. The service may perform maintenance and temporarily suspend services in case of security or stability threats.

2.3. Terms and prices may change for future orders and renewals. Paid configurations are not reduced before term expiration without user consent, violation, or technical necessity.

2.4. The service resolves verified infrastructure faults within a reasonable timeframe.

3. User Obligations

3.1. Users must comply with the offer, terms of service, laws, and plan technical limitations.

3.2. Users must not attempt to access unauthorized data, networks, containers, or service systems.

3.3. Penalties for violations are applied according to Section 4 of the offer, and refund matters according to Section 7 of the offer.

4. Shared Resources

4.1. The service is virtual game hosting on shared physical infrastructure, not dedicated server rental.

4.2. User containers are isolated from others, but node CPU, physical RAM, disk I/O, and network are shared.

4.3. vCore, RAM, and disk values are available container limits, not exclusive physical hardware allocation.

4.4. Short load spikes are permitted. Continuous 24/7 CPU usage, excessive disk I/O, maximum bandwidth utilization, or other loads degrading shared resources may be restricted.

4.5. Without immediate threat, the service notifies the user before applying prolonged restrictions.

5. Prohibited Activities

5.1. Malware, illegal content, DoS/DDoS, phishing, botnets, crypto mining, hacking, and dangerous activities are prohibited.

5.2. Unauthorized tunneling or network resource resale is prohibited.

6. Service Termination

6.1. In case of gross violations or immediate threats, the service may immediately suspend or terminate service.

6.2. Refunds upon termination are governed by Section 7 of the offer, not automatic forfeiture by blocking.

6.3. Information is transferred to authorized authorities only on legal grounds and in required scope.

7. Miscellaneous

7.1. The website may use essential cookies and local storage for service functionality.

7.2. Backups are created by users via the control panel and stored according to the public offer term.

7.3. Separate guaranteed SLA is not provided unless explicitly stated in the plan or agreement.

7.4. The current version of the agreement is available on the website.

8. VPS Usage Rules and Fair Use

8.1. Shared infrastructure is intended for normal use of resources by all users. Fair Use does not prohibit use of the purchased plan and does not introduce hidden limits such as 50% CPU or a fixed Mbps cap.

8.2. Short-term use of 100% of available vCPUs is normal, including during startup, compilation, game-world generation, database operations, backups, software updates, and other short computing tasks. Restrictions are possible only for prolonged or systematic load that materially affects the shared node, other users, storage or network stability, constitutes abuse, or is intended to bypass technical limits.

8.3. Prolonged intensive disk I/O, mass file creation, continuous archiving, continuous use of maximum network speed, or other load materially degrading shared infrastructure may likewise be restricted. Where there is no immediate threat, the service will first notify the user and provide an opportunity to optimize the VPS or change plans.

8.4. VPN, proxy, Tor, game hosting, web hosting, bots, and cryptocurrency nodes are allowed when lawful, non-abusive, and compliant with these rules. Cryptocurrency mining is prohibited.

8.5. Malware, phishing, botnet/C2 activity, spam, DoS/DDoS, brute force, deliberate malware distribution, unauthorized scanning of third-party ports or networks, attempts to bypass isolation or access other parties’ data, and other conduct described in the Abuse Policy are prohibited.

8.6. The user is responsible for OS and software updates, passwords, SSH keys, firewall configuration, backups, and responding to VPS compromise. Compromise itself is not automatically treated as intentional wrongdoing, but the user must take action after notice.

8.7. Technical restrictions, temporary suspension, and abuse response are governed by these Terms and the Abuse Policy. Suspension does not by itself mean automatic forfeiture of all funds; refunds are considered under Section 7 of the offer, subject to applicable law.
